Terms of Service

These Terms govern your purchase and use of TuckGem, an independent Windows desktop application for backing up eligible Telegram chats and media. By purchasing, activating or using TuckGem, you agree to these Terms.

1. Seller and contact

TuckGem is sold by Manussawe Gumsorn. Product and billing support is available at [email protected].

2. What you are buying

Each plan is a one-time purchase for a non-exclusive, non-transferable licence for one person to use TuckGem on one active Windows device at a time.

• Manual: you start each backup yourself. Saved presets also make daily backups convenient.
• Auto: includes Manual features and can follow multiple selected chats while the app is running.
• Upgrade to Auto: is available only from a valid Manual licence inside TuckGem. A successful upgrade replaces your active Manual entitlement with Auto; the original Manual entitlement is suspended while the upgrade is active. Refunding the upgrade restores Manual, provided the original Manual purchase remains valid. Refunding the original Manual purchase also invalidates the Auto entitlement derived from it. This linked-entitlement rule applies to upgrades processed after the new upgrade system is deployed; earlier upgrades retain their original licence arrangement unless explicitly migrated.

Prices are shown in USD. Any tax or currency conversion is displayed by Stripe before payment.

3. Delivery and activation

After a successful payment, the licence key and download instructions are sent to the email address entered at checkout. You are responsible for entering a working email address and keeping your key private. If delivery does not arrive, check spam and contact support with the payment receipt.

Your licence key is verified on your computer. While you are online, TuckGem periodically checks that the licence has not been refunded, disputed or moved to another device. You can move the licence between devices within the safeguards shown by the app, and the purchaser can request a reset code by email.

4. Telegram access and backup limits

You must use your own Telegram account and have authority to access and back up the selected content. TuckGem can only retrieve information made available through Telegram's interfaces and your account permissions. TuckGem does not bypass content protection or access controls. Files from chats protected against saving may be loaded for viewing only while the application is in use; they cannot be backed up, saved or exported through TuckGem. Temporary files loaded for this viewing are deleted when the application closes. Secret Chats are not supported: they cannot be viewed or backed up in TuckGem. Availability can also be affected by deleted messages, expiring media, Telegram rate limits, connectivity and changes made by Telegram.

You are responsible for complying with Telegram rules and using your account and API credentials for permitted purposes. If Telegram restricts or suspends your account, API credentials or API access because of your misuse, prohibited activity or breach of Telegram rules, we do not provide a refund or compensation solely on that basis, except where required by applicable law. This does not exclude claims arising from a defect in TuckGem or inaccurate product descriptions.

A Telegram FloodWait response is a temporary rate limit requiring a pause before retrying the affected action. Receiving FloodWait alone is not evidence of misuse, an account ban, or a breach of these Terms.

TuckGem is independent software and is not affiliated with, endorsed by or sponsored by Telegram.

5. Your files and responsibilities

Backups are stored on the computer and location you select. You are responsible for storage capacity, device security, additional copies of important files and compliance with privacy, copyright, employment and other laws that apply to the content you back up. Do not use TuckGem to access another person's account, evade access controls or collect content unlawfully.

6. Acceptable use

You may not share, resell, sublicense or publish a licence key; reverse engineer or circumvent licence controls except where applicable law expressly permits it; use the software to harm a service or person; or use it for unlawful surveillance or infringement.

If you modify or alter the application code, technical support and eligibility for future updates will be discontinued for the licence key used with that modified application.

7. Updates

Your purchase includes eligibility for TuckGem software updates for one year from the purchase date. A successfully applied Upgrade to Auto starts a new one-year update entitlement for Auto from the upgrade purchase date. If the upgrade is fully refunded and Manual is restored, the original Manual update expiry applies; the refunded upgrade does not extend Manual update eligibility. After that period, you are no longer entitled to new updates under that purchase. Update availability may end earlier if Telegram discontinues API access needed by TuckGem. This update entitlement does not guarantee that Telegram will maintain API access or that the software will remain compatible with future Telegram or Windows changes.

8. Refunds, disputes and licence status

Our Refund Policy forms part of these Terms. A full refund, reversed payment or payment dispute revokes the licence issued for that payment. For upgrades processed under the linked-entitlement system, a full refund of the upgrade revokes Auto and restores Manual if the original Manual purchase remains valid. A full refund of the original Manual purchase also invalidates Auto derived from that purchase. Earlier upgrades retain their original licence arrangement unless explicitly migrated. Status changes take effect when the application next completes an online licence check. If you believe a charge is wrong, contact support first so we can investigate promptly.

9. Disclaimer and liability

TuckGem is provided with the features described on the purchase page. We do not guarantee uninterrupted operation, that Telegram will continue exposing the same data, or that every message or file can be recovered. To the extent permitted by law, our total liability arising from the product is limited to the amount you paid for the affected licence. We are not liable for indirect or consequential loss, lost content, or loss caused by a third-party service. These limits do not exclude rights or liabilities that cannot legally be excluded.

10. Termination and changes

You may stop using TuckGem at any time. We may suspend or revoke a licence obtained fraudulently, refunded or disputed, shared in breach of these Terms, or used unlawfully. We may update these Terms for future purchases; the version presented when you purchased continues to govern that order unless a change is required by law or is more favourable to you.

11. Governing terms

These Terms are governed by the laws applicable to the seller identified on your receipt, without removing any mandatory consumer rights you have in your country of residence. If a provision is unenforceable, the remaining provisions continue to apply.
